Development & Zoning Implications of SB 840

At the September General Membership meeting, special guest Barbara McArthur presented important information about a bill passed by Brian Hughes at the state level that allows commercial properties to be rezoned as residential, to the highest residential density available, automatically and without requiring a rezoning change.

This represents a significant change to how development has historically been planned and regulated, and could facilitate accelerated development and increased density in our neighborhood.

With the new designation, there are no FAR limits or traditional setback requirements, and the height can automatically increase to a maximum of 45’ vs 35’ and 40’ in some of the lower height zoning today, otherwise it does not increase height.
